1. Definitions

Buyer means any individual or organisation who purchases or agrees to purchase goods from the Seller.

Consumer has the meaning defined under Section 12 of the Unfair Contract Terms Act 1977.

Contract means the agreement between the Seller and the Buyer for the sale and purchase of Goods in accordance with these Terms & Conditions.

2. Conditions

Nothing in these Terms & Conditions affects the Buyer’s statutory rights as a Consumer.

These Terms apply to all contracts for the sale of Goods by the Seller and override any other terms proposed by the Buyer.

Acceptance of Goods upon delivery constitutes acceptance of these Terms & Conditions.

Any variation to these Terms shall only be valid if agreed in writing by the Seller.

Any complaints should be directed to the Seller using the contact details provided on the Website.

3. Ordering

All orders placed by the Buyer are considered an offer to purchase and are subject to acceptance by the Seller.

If an ordered item is unavailable, the Buyer will be informed and may choose to wait for availability or receive a full refund within 30 days.

The ordering process and technical steps are clearly outlined on the Website during checkout.

4. Price & Payment

All prices displayed on the Website include VAT (where applicable) but exclude delivery charges.

The total price, including VAT and delivery costs, is shown before order confirmation.

Order confirmation will be sent via email once the order is received.

Full payment must be made before Goods are dispatched.

5. Seller’s Rights

The Seller reserves the right to change prices at any time but will ensure accuracy at the point of purchase.

The Seller may withdraw any product from the Website without notice.

The Seller shall not be liable for refusing or cancelling an order.

6. Warranty

The Seller warrants that Goods will match their description at the time of dispatch.

Except where the Buyer is a Consumer, all implied warranties relating to fitness for purpose are excluded.

7. Delivery

UK deliveries usually take 2–3 working days from order acceptance.

Delivery dates are estimates and delays do not entitle the Buyer to compensation.

Goods are delivered to the address provided by the Buyer, and signature may be required.

Risk and ownership of Goods pass to the Buyer upon delivery.

8. Cancellation & Returns

Buyers must inspect Goods upon receipt and notify the Seller within 7 working days if items are damaged or incorrect.

Defective Goods must be returned for a full refund, including delivery costs.

Consumers have the right to cancel orders within 7 working days of receipt.

Returned Goods must be unused, in original packaging, and returned at the Buyer’s expense.

Refunds are processed within 30 days of cancellation approval.

No refund will be issued for Goods damaged due to Buyer misuse.

9. Limitation of Liability

The Seller’s liability shall not exceed the value of the Goods purchased.

The Seller is not liable for indirect or consequential losses.

Nothing excludes liability for death or personal injury caused by negligence.

10. Waiver

Failure by the Seller to enforce any right shall not constitute a waiver of that right.

11. Force Majeure

The Seller shall not be liable for delays caused by events beyond reasonable control, including natural disasters, strikes, or system failures.

12. Severance

If any provision is found unenforceable, the remaining provisions shall remain valid.

13. Changes to Terms

The Seller may update these Terms at any time. Updated Terms will not affect existing orders.

14. Intellectual Property

All content on www.gofest.uk is the property of GoFest UK Ltd. Reproduction without permission is prohibited.

15. Governing Law

These Terms are governed by the laws of England & Wales, and disputes shall fall under the exclusive jurisdiction of English courts.
